Credit Ombudsman Service Ltd (COSL)

The Credit Ombudsman Service is an external dispute resolution scheme established by Credit Ombudsman Service Limited (COSL) and approved by the Australian Securities & Investments Commission (ASIC).

The Credit Ombudsman Service provides consumers and members with an alternative to legal proceedings for resolving their disputes.

The broad aim of the Credit Ombudsman Service is to provide independent and prompt resolution of disputes in accordance with:

relevant legal requirements
the Mortgage & Finance Association of Australia (MFAA, formerly MIAA) Code of Practice and other recognised Codes of Practice
good practice in the credit industry
fairness in all the circumstances.
Individuals who refer their complaint to the Credit Ombudsman Service can have their complaint determined by the Credit Ombudsman. The Ombudsman's decision is binding on a Member only if the consumer accepts the Ombudsman's decision.

The Ombudsman can only deal with disputes where the amount of the claim is $250,000 or less.

So what is the purpose of a credit bureau?

The purpose of a credit bureau is to act as an independent source of information on credit applicants. Credit providers can therefore make an informed decision during the application process. As such, a credit bureau must:

provide a credit provider with all the available information relating to the applicant, including other identities that the entity may be using;
provide a credit provider only with information relating to the applicant at the point of enquiry; and
provide consistent responses regardless of minor variances in input data.
All advanced economies rely on the existence of one or more credit bureaux to reduce the risks associated with providing credit and therefore minimise interest rates within the wider community.

Providing comprehensive coverage and analysis of the credit-active population, including individuals, companies, businesses and sole traders, is a critical aspect of running an effective bureau.
